2.1 General

  • Barrier height not less than 1.2m on approach side

  • Barrier & gate must be a permanent structure, made from durable material

  • Barrier (other than retaining wall) not to lean away from pool more than 15⁰

2.2.2 NCZ barriers less than 1.8m in height

  • NCZ 1 - 900mm vertical plane on outside face of barrier.

  • NCZ 2 - 900mm radius down from the top of the barrier (outside)

  • NCZ 3 - 900mm radius up from top of barrier (outside).

  • NCZ 4 - 900mm high by 300mm deep on inside of barrier.

  • Horizontal rails in barrier spaced a min of 900mm apart

2.2.3 Barriers not less than 1.8m in height

  • Do NOT require an NCZ & may be climbable on both sides.

2.2.4 Boundary barriers

  • Height not less than 1.8m on pool side.

  • NCZ 5 - 900mm radius down from top of barrier on inside

  • (a) NCZ 5 - intersecting barrier within NCZ 5 to be less than 50mm in width & intersects at an angle of between 45⁰ & 135⁰,

  • (b) NCZ 5 – where the intersecting barrier is greater than 50mm wide within NCZ 5 that barrier shall not be less than 1.8m high and extend for not less than 900mm from the boundary barrier.

2.2.5 Intersecting barriers

  • When a barrier less than 1.8m high intersects with a barrier over 1.8m high at an angle greater than 90 degrees then NCZ 1 & 2 extends 900mm beyond.

2.3.1 Features and objects near barrier

  • No objects or level changes within 500mm on outside of barrier

2.3.2 Perforated material or mesh (measure openings horizontally)

  • (a) Openings in fence not greater than 13mm shall have fence height min 1.2m.

  • (b) Openings in fence greater than 13mm but less than 100mm shall have fence height min 1.8m.

  • (c) Openings greater than 100mm not permitted.

  • (e) (i)Support 25kg on top and not reduce height. (ii) bottom of barrier can’t be lifted to create 100mm or greater opening.

2.3.3 Glass Barriers

  • Complies with AS 1288

2.3.4 Surface projections & indentations

  • No foothold/handhold allowed greater than 10mm within NCZ 1, unless compliant as per (a)(b)(c) below

  • (a) All such lower surfaces shall be not less than 900 mm from the top of the barrier.

  • (b) All such higher surfaces shall be not less than 900 mm above the finished ground level

  • (c) High and low surfaces shall be not less than 900 mm apart.

2.3.5 Horizontal components

  • Any protrusions or indentation shall not exceed 10mm OR where they exceed 10mm shall be spaced more than 900mm apart

2.3.6 Vertical components

  • Opening no greater than 100mm

2.3.7 Ground clearance

  • Gap between ground and barrier no greater than 100mm.

  • Surface underneath barrier is permanent.

2.4.1 Gates

  • 2.4.1.1 - Gate swings away from pool area

  • 2.4.1.1 - Arc of gate operation clear of any building or doorway

  • 2.4.1.1 - Opening under closed gate not greater than 100mm

  • 2.4.1.2 - Self-closing device fitted

  • 2.4.1.2 - Self-closing device will close the gate from any open position without manual force

2.4.1.3 Security of closure - when gate is closed and latched it can’t be:

  • lifted to release the latch OR,

  • unhinge the gate OR,

  • increase the gap underneath greater than 100mm.

2.4.2 Latch

  • Automatically operate on the closing of the gate.

  • Cannot be re-opened without manual release.

The latch shall not be able to:

  • (a) inadvertently be adjusted during operation;

  • (b) locked in the ‘open’ position; or

  • (c) adjusted without the use of tools.

2.4.2.2 Location of latch

  • Minimum 1.5m high.

If less than 1.5m high the latch must be:

  • (a) On the inside of the barrier;

  • (b) Access to the latch must be in a position to reach over or through the barrier no lower than 1.2m above FGL OR,

  • Not less than 1m above the highest lower rail.

  • (c) At least 150mm below the top of barrier or hand-hole.

2.4.2.3 Shielding of latch when latch is below 1.5m

  • No opening greater than 10mm within 450mm of latch

  • 450mm shielding required around latch

  • If there is a hand hole in the gate to access the latch it must be no lower than 1.2m above FFL

  • Latch minimum 150mm below top of gate or top of hand hole

2.4.3 Gate hinges

  • Hinges greater than 10mm in depth to be minimum 900mm apart, OR top surface to be sloped minimum 60⁰.

2.5.1 Retaining wall above pool level

  • Not sloped away from pool area more than 15⁰

  • If less than 1.8m high must comply with 2.1, 2.2.2, 2.3.4 & 2.3.5.

2.5.2 Retaining wall below pool level

  • Not slope towards the pool by more than 15°

  • If less than 1.8m high must comply with 2.1, 2.2.2, 2.3.4 & 2.3.5.

  • If internal barrier intersects with retaining wall it must overhang 900mm or return 90 degrees 900mm.

2.5.3 Out-of-ground pool walls

  • 1.2m high and NCZ clear

2.5.4 Permanent bodies of water considered a barrier in the following circumstances

  • Width greater than 1800mm & not less than 300mm deep

  • Pool owner must provide evidence showing that the body of water is permanent and the water at the edge of the pool area is not less than 300 mm deep at any time.

2.6 Child resistant windows (less than 1.8m from window opening to pool FGL)

  • Openable part of window/s restricted to max opening of 100mm OR

  • Protected by a security screen (not flyscreen) securely fitted to the openable part of window/s OR

  • The window opening protected by bars having spacing not exceeding 100mm

2.7 Child resistant doorsets (indoor pools only)

  • (a) fitted with a self-closing device

  • (b) Self-closing device closes the door from any open position without manual force.

  • (c) complies with Clause 2.4.2 (latch).

  • (d) latch 1.5m minimum above FFL.

  • (e) NCZ 1 clear (located from 1.2m above floor).

  • (f) [if perforated mesh] shall comply with Clause 2.3.2

  • (g) pet doors in doorset not allowed

  • (h) door opens away from pool area

2.8 Balcony balustrades

  • If the balcony protrudes into a NCZ it must comply with 2.1 & 2.2.2 (i.e. act as a safety barrier)

2.9 Above-ground pools (no barrier)

  • If pool sides are greater than 1.2m high, stable and NCZ’s are clear then the pool itself is considered an adequate barrier.

  • A barrier and gate shall be provided in accordance with Clauses 2.1 to 2.4 around the access ladder.

Reg 147ZF - circumstances in which a certificate of barrier NON-compliance must be issued immediately

  • Is the barrier incapable of being made compliant within 60 days?

  • Is the owner unlikely to bring the barrier into compliance within 60 days?

  • Does the non-compliance pose a significant risk to life or safety?

  • Can the gate/doorset be open without operating the latch?

  • Is the gate/doorset unable to be closed completely?

  • Is any part of the barrier less than 1m in height?

  • If the answer is yes to any of these questions, then a Form 24 must be issued immediately.

Compliance

  • Is Pool Safety Barrier compliant with the applicable standard to allow for a Form 23 - Certificate of Compliance to be issued. OR

  • If non-compliant, will you instead issue the owner a list setting out the standard non-compliant items, giving the owner maximum 60 days in which to bring the Pool Safety Barrier into compliance with the applicable standard.

  • Note. Inspector must advise owner of their intention to carry out are inspection specifying a date not more than 60 days after the owner receives the notice.
