1. Doors located in Walls forming part of the Pool safety barrier

  • Does the door which forms part of the pool barrier have a self locking or self latching device that prevents the door, if the door is in its closed position, from being opened by a person unable to reach the opening mechanism for the door and

  • Is the opening mechanism on the door located a minimum of 1500mm above the ground level or the internal floor level measured from the approach side and-

  • Does the door have a device fitted which returns the door to its closed position from any stationary position from fully open to resting on the lock or latch without the use of manual force.

  • Are there any foot holds on surfaces more than 10mm deep in which a young child could gain access to the locking or latching device.

2. Windows located in Walls forming part of the Pool safety barrier

  • (Note. Choose only one item — remainder are N/A.)

  • Is the openable part of the window a minimum of 2400mm above the ground or pavement level external to the window? OR

  • Is the openable part of the window located a minimum of 1200mm above the floor of the room containing the window OR

  • Is the openable part of the window between 900mm and 1200mm above the floor level and the opening section is fitted with a securely fixed fly screen OR

  • Is the openable part of the window not greater than 1200 mm above the floor level and the openable part of the window is covered by bars or a mesh screen having openings no greater than 105 mm that can only be removed by the use of a tool or is fixed permanently shut

3. Pool Barrier Fence

  • Does pool fence have a minimum height of 1200mm measured from approach side

  • Are gaps between glass panels 100 mm or less in width

  • Are vertical wire or aluminium member spacing a maximum of 100mm apart.

  • Has ground clearance beneath perimeter of pool safety barrier been maintained at a maximum gap of 100mm.

  • Has ground clearance beneath perimeter of pool safety barrier been maintained at a maximum gap of 100mm.

  • Is ground beneath pool fence stabilised or paved to prevent young children from gaining access beneath the pool fence. (Ground firm and well compacted, no loose sand or pebbles etc)

  • At stepped or staggered panels has a non climb zone of 900mm been maintained. (NCZ 900mm & 1100mm above highest lower climbable member to top & 1200 high)

  • Is the pool fence ridged and stable. (Barrier to be able to withstand impact by child )

  • Has an outside Non Climbable zone of 1200mm been maintained around the entire outside perimeter of the pool fence. ( No climbable objects eg trees , pot plants, etc within an arc of 1200mm measured from top of pool fence)

  • Has an inside Non Climbable zone of 300mm been maintained around the entire inside perimeter of the pool fence. (No climbable objects within 300mm of inside of pool fence)

  • Are all horizontal rails spaced a minimum of 900m apart and the bottom rail located a minimum of 1100mm below top of pool fence.

  • Is the pool fence free of any finger or footholds greater than 10mm in depth on the surface or within a 1200mm radius (Arc) and are such footholds a minimum of 900mm apart.

  • Has wire mesh been used as part of the pool fence and if so are apertures 13mm or less in width.

  • If wire mesh used in the construction of the pool fence, are horizontal wire strands more than 900mm apart.

4. Pool Gates / Latches.

  • Do pool gate/s swing outwards away from pool

  • Is the pool gate self closing and self latching from any position without the use of force including at the latch or from the full open position.

  • Is the latch release height a minimum of 1500mm above ground level OR

  • Is the latch release mechanism located on the inside of the pool gate and less than 1500mm above ground or pavement level.

  • If so, is it located a minimum of 150mm from top of pool gate.

  • If so, is the gap at the closing side of the gate 10mm or less

  • If so, is latch shielded for a clear radius of 450mm

  • Are gate hinges located a minimum of 900mm apart or if less than 900 mm apart are hinges fitted with cone tops to prevent climbing.

  • Is pool gate height a minimum height of 1200mm measured above adjoining ground level.

  • Is the gap beneath the pool gate 100mm or less

  • Is the latching device not able to be adjusted without the use of tools, nor lockedin an open position.

  • Are the pool gates permanently hung and not able to be lifted off the hinges

  • Is the pool gate prevented from being propped or held open with devices

  • If the pool gate is constructed of timber pickets are the gaps between the pickets greater than 10 mm and if so are there any footholds such as rails or bracing which would allow a young child to gain access into pool area.

  • Does the pool gate remain in the fully latched position after a weight of 25kg has been applied 100 mm in from the closing side at the top rail position.

5. Boundary Fences forming part of Pool safety barrier

  • Is the timber paling or wire mesh fence a minimum of 1200mm in height

  • If wire mesh used as a barrier - are openings in wire mesh no greater than 13mm

  • Are the fence rails if located on the approach side of the boundary fence a minimum of 900 mm apart including at adjoining fence junctions. (If not a 1200 mm non climb zone is to be provided or fence rails to be made non climbable).

  • Has a no climb zone on 1200mm measured in an arc from top of the boundary fence been maintained on the approach side of boundary fence .(Objects such as trees , outbuildings etc located on the approach side of boundary fences which present as a climbing point within the 1200mm non climb zone. A no climb zone of 1200mm must be maintained at the approach side of all boundary fences )

  • Is the intersection of pool barrier fence and boundary fence protected with a 1200mm non climb zone measured from top of pool fence to top of boundary fence.

  • At the pool fence- boundary fence intersections, are fence rails located on the pool side of fence, if so has a 1200mm wide non climb zone been provided on the approach side and a 300mm wide non climb zone been provided on the inside of boundary fence.

6. Gates including yard gates, driveway gates forming part of Barrier

  • Are gates a minimum height of 1500 mm

  • Do gates self close and self latch from any position

  • Are gates kept closed at all times

  • Do gates have a latching device installed at a minimum height of 1500 mm OR

  • If latching device is installed less than 1500 mm, is the latching device located on the inside of the gate AND

  • Is latching device shielded for a minimum radius of 450 mm.

7. Retaining Walls

  • Is Retaining Wall located on the high side of the pool ( i.e. Is the slope located on inside of pool area)

  • If so, does it have an effective height of at least 2400mm and if so

  • Does the outside surface have any projections and or indentations with a depth of 10mm or more and if so,

  • Are they spaced at least 900mm apart and at least 1100mm below the top of the barrier and

  • Does the retaining wall slope away from the pool by not more than 15° to the vertical

  • OR -- Is the retaining wall slope located on the approach side or outside to pool area.

  • If so, does it have an effective height of at least 1200mm and if so

  • Does the outside surface have any projections and or indentations with a depth of 10mm or more and if so,

  • Are they spaced at least 900mm apart and at least 1100mm below the top of the barrier and

8. Above ground pools.

  • Are the walls of above ground swimming pool a minimum of 1200mm in height measured above the adjoining ground or pavement level.

  • Is there a 1200mm clear non climb zone around the perimeter of the pool including pumps, filters and the like.

  • If so is the pool ladder stored away when not in use.

9. Balcony

  • Is a balcony projecting into a pool area?

  • If so, is the distance of the floor of the balcony to the pool surround measure less than 2.4m?

  • If so, do the windows and doors to the balcony comply with child-resistant windows and doorsets? OR

  • Does the balcony include a balustrade with complies with the requirements for a fence in this Standard.

10. Strength and rigidity of fencing components

  • Is the strength and rigidity of the barrier sufficient to resist the forces applied that could reasonably be expected during normal usage. Note: This can be assessed by an average sized adult pushing against the barrier at the critical points i.e. at the highest point of barrier and half way between posts.

11. Part 9A -Division 6 — Building Regulations 2018 - Regulation 147ZF

  • If in the opinion of the Inspector any of the following exist, the Inspector must immediately issue a Certificate of Pool and Spa Barrier Non-compliance (Form 24) to the owner of the land . An answer of YES signifies a Critical Non Compliance.

  • Is the barrier incapable of being made compliant with the applicable standard within 60 days

  • Is the owner unlikely to bring the barrier into compliance with the applicable standard within 60 days.

  • Does the non compliance with the applicable standard pose a significant and immediate risk to life or safety.

  • Is there any door and or gate which forms part of the barrier, when in the closed position, is able to be opened by a person who is unable to reach the opening mechanism for that door or gate.

  • Is there any door or gate which forms part of the barrier unable to be completely closed.

  • Is there any part of the barrier less than 1m in height measured above the ground

12. Compliance Decision

  • Is Pool Safety Barrier compliant with the applicable standard to allow for a Form 23 -Certificate of Compliance to be issued. OR

  • If non-compliant , will you instead issue the owner a list setting out the non compliant items, giving the owner 60 days in which to bring the Pool Safety Barrier into compliance with the applicable standard. OR

  • If Critical Non-Compliant, you will instead issue a Form 24 Certificate of Non Compliance . (Copy must be sent to Local Council — Building Surveyor)
