PJ Slater Scaffolding Services Ltd are committed to maintaining an active policy of excellence in Health, Safety, Quality and the Environment (HSEQ) for employees, customers and anyone who may be affected by our business. It is the company’s intention that HSEQ performance is an integral part of efficient and successful Business Management.

It is the responsibility of Management and members of staff to ensure that Health, Safety, Quality and the Environment is protected, that working conditions are as safe as it is practicably possible and conform with all relevant statutory legislation. Although Management have a duty to monitor the performance, it is the PRIMARY RESPONSIBILITY OF ALL STAFF to maintain Company standards and to minimise loss in any form including personal injury, damage to plant and property, or interruption of productivity.

It is the Company’s clear objective to be active in HSEQ management. To maintain the impetus all Company employees must continually strive to improve HSEQ performance and monitor levels of compliance. Code of Conduct

Purpose of this code of conduct
-
PJ Slater Scaffolding Services Ltd are committed to providing our customers with a safe, efficient and high quality service as declared in our Policies and Objectives. To achieve this, it is important that you know the standards ofconduct expected of all our Operatives and Sub-Contractors. It is the responsibility of all Directors, Managers and Foremen to make sure their operatives and are aware of this Code and that they understand its importance and work to it.

In this Code of Conduct, reference to Customers includes Clients, Premises Managers, Residents, Householders, Tenants and all other users of Clients premises.
-
Working arrangements and Absence
-
• All operatives and sub-contractors will be expected to work 8 hours per day plus overtime as required
-
• Working times will be as required by management
-
• In the event of personal absence from the contract, the operative or sub-contractor concerned must notify Contracts Manager or supervisor as soon as possible BUT no later than 6.00am. Do NOT leave it until the last minute. If you know in advance, tell us in advance.
-
• Absences can be notified by text but must be followed but by a phone call by 10am on the day of absence. Failure to do so may result in disciplinary action
Your Safety, Well-Being and Behaviour Standards
-
• All operatives and sub-contractors must adhere to all safety rules and wear Personal Protective Equipment when instructed to do so by safe working procedures, method statements and safety signage.
-
• All accidents or incidents must be reported to a contract manager or the office immediately and all required reports filed as per the requirements of PJ Slater Scaffolding’s Health & Safety Policy
-
• Foul or abusive language, lewd behaviour, racist, or sexist or derogatory remarks, will not be tolerated. violent or aggressive behaviour towards clients, the general public or PJ Slater operatives will not be tolerated. Treat others how you wish to be treated.
-
• All operatives must follow the safe system of work given to them and report any problems with the safe system of work, dangerous conditions or actions observed during their working day. You are required by law to assist management to rectify the situation and report dangerous situations. Don’t walk by.
-
• Report any near misses and help us improve safety.
-
• Only eat, drink or smoke in areas where you are allowed to do so. If you do not know where this is permitted, please ask. Smoking in any building is strictly forbidden. Dispose of smoking and food wastes materials properly.
-
• Do not arrive at work under the influence of alcohol or drugs. If you are taking any prescription medication you must inform your manager, especially if the medication may affect you or others around you.
-
• The drinking of alcohol and use of illicit drugs during working hours is strictly forbidden. Bringing any illicit drugs into the workplace is strictly forbidden and is a Gross Misconduct offense as well as a criminal offence.
-
• Do not take any property (including scrap) belonging to the company or the client without proper permission. Where appropriate, written permission should be sought.
Equipment (Tools, work wear and PPE)
-
• All operatives and sub-contractors are to wear PJ Slater Scaffolding logo t-shirts or sweatshirts whilst at work. If worn outside working hours you will remain responsible for your conduct and how you are perceived whilst wearing the PJ Slater brand. Report any issues with company work wear as company image is important.
-
• If you are issued with any equipment such as hand tools, power tools, protective equipment (list not exhaustible) you will be required to sign for these. You alone are responsible for keeping these in good working order and safe from theft. If an item becomes legitimately damaged, ceases to work or has come to the end of its life span during normal operation, the item is to be returned for replacement or repair.

• If you leave the company you will be required to return all equipment issued to you (some exceptions apply). The company reserves the right to withhold final salary payment in lieu of any equipment not returned or returned in an unsatisfactory manner.
-
• No responsibility will be taken for tools / possessions left in the yard, vehicles or clients premise.
-
The company is not responsible for the security of your possessions. Please ensure that all personnel possessions are secure and are removed and taken with you at the end of every day.
-
• Wilful neglect of company property will not be tolerated and where a person is deemed to be negligent, the costs of replacement or repair will be met by you.
Vehicles
-
• Company vehicles advertise our business. Advertising brings new and repeat business securing work and therefore our reputation and good company image must be maintained at all times.
-
• All operatives and sub-contractors using Company transport must ensure that Daily Checks are carried out and any defects are reported to the Contracts Manager. Vehicles are to be kept clean and tidy.
-
• Do not leave any newspapers or magazines on view in the cab.
-
• When driving a company vehicle we expect all operatives to drive in a safe and courteous manner, failure to do so may lead to disciplinary action.
-
Working at PJ Slater Scaffolding Services Ltd Premises
-
• When working in the yard area, Hi-Vis clothing and safety footwear will be worn at all times. If you have no need to be in the yard, leave the area as soon as possible.
-
• If you need to visit the office before or after work for a legitimate reason, please do so. Remember that this is someone else’s work place so treat it with respect and if required, use a quite area to discuss matters.
Working on site
-
• All operatives and sub-contractors must ensure that a Quality Finish is achieved
-
• Where a client’s site office is utilised, all operatives and sub-contractors must report to this facility each morning to record the number of operatives present on site each day, receive instructions and notify site manager of any issues relating to the Contract.
-
• Before starting work, take a moment to study the work area for any hazards. Look out for any hazardous debris e.g. needles or syringes and report as required. Do not move any items such as waste bags that you don’t know the contents of. If in doubt, please ask.
-
• All work must be carried out in a safe manner in accordance with the risk assessment and method statement. Safe working is not negotiable, nor is it an option. Materials are to be stored safely, scaffolding secured and any all access from ground level is to be removed when not on site or overnight.
-
• Any request for additional works by the customer must be forwarded to PJ Slater Scaffolding Services Ltd management as soon as possible.
-
• Customers must be approached in a courteous manner, with special consideration given to Senior Citizens.
-
• Do not engage in any disputes with clients. If clients become aggressive, are under the influence of drugs or alcohol, leave the work area immediately and call management for further instruction.
-
• You must not place yourself in a position where you are alone with a child. If no other adult is present, do not enter the premises, stop work and seek further instructions.
-
• Customer’s possessions must be treated with respect and protected if vulnerable to dirt, dust or other damage.
-
• Where the customer is a resident, you must ensure that their home is secure at all times.
-
• Do not use or remove any of the customers facilities without permission
-
• The use of radios, cassette players or personal CD players is forbidden
-
• Any complaint must be reported in the first instance to the Site Manager or the Contracts Manager
-
• All debris, dust and rubbish from the works must be cleared away as you work to keep a tidy and safe workplace. If you drop it, pick it up. Dispose of any items in an appropriate waste container on site or back at the yard.
-
• Any accidental damage caused when working on site must be reported immediately to contract management, failure to report damage may result in any cost incurred deducted from operatives wages.
-
• Any claim resulting from negligent workmanship or practice will be the responsibility of the operatives and sub-contractors concerned. All costs incurred by the Company will be deducted from the operatives or sub-contractors pay, as negligence is not covered by any insurance.

Failure to comply with this Code of Conduct
-
• Minor Breaches will be dealt with verbally by the Foreman, Site Manager or Contract Manager and will be recorded
-
• Major breaches in this code of conduct will be reported to the Directors. A disciplinary investigation may follow as a result; this may result in disciplinary action being taken.

Self-Employment Contract

THIS SERVICES AGREEMENT IS MADE ON:-
-
BETWEEN:- PJ SLATER SCAFFOLDING SERVICES LTD ("the Contractor)"
AND:- -
"THE SUBCONTRACTOR" (enter name)
Background
-
1) The Contractor’s business is in scaffolding erection. The Contractor tenders for and is appointed by its clients to complete a project for specified works at a certain site or location (the “Assignment”)
-
2) The Subcontractor has skills and abilities which may, from time to time, be available to the Contractor (the “Services”)
-
3) The Contractor and the Subcontractor agree that if the Subcontractor offers to make his services available to the Contractor and is engaged by the Contractor, the terms and conditions of this Contract for Services shall apply.
-
4) It is the intention of the parties that when the Subcontractor provides the Services to the Contractor for an Assignment, such provision of Services shall constitute a separate and distinctive engagement under this Contract for Services. Unless varied or amended or otherwise agreed between the parties under Clause 30, these terms and conditions shall apply for each engagement.
Operative Provisions
-
5) The Contractor is not obliged to offer work on any Assignment to the Subcontractor, neither is the Subcontractor obliged to accept any work offered. The Subcontractor is not obliged to make his Services available at any time. Specifically both parties agree that they do not intend to create or engagement.
-
6) In providing the Services to the Contractor, the Subcontractor:- a. shall exercise reasonable skill, care and diligence and shall apply the highest professional standards;
-
b. shall do nothing which is likely to bring the Contractor into disrepute or which is materially contrary to the interests of the Contractor
-
c. shall observe current published policies of the Contractor relating to health and safety, bullying and harassment, discrimination, use of computer facilities, data protection and any other similar policies issued by the Contractor from time to time.
-
7) The Subcontractor is free to use his own initiative as how best to complete the Services and has the flexibility to arrange how and when the Services are carried out, always provided that this does not reasonably interfere with or delay other works being carried on by or on behalf of the Contractor or with any site restrictions in place on a particular Assignment.
-
8) The Subcontractor is free to provide any services to any other party at the same time as being engaged by the Contractor and the Contractor acknowledges that it will not have first call on the services of the Subcontractor in priority to any third party.
-
9) The Subcontractor is responsible for providing his own equipment, tools and safety equipment. Personal protective clothing, complete with the Contractor’s company logo, will be supplied as type of Assignment is specialised or the Services are labour-only services

10) The Subcontractor accepts that he is responsible for the Services and that he is responsible for covering his own risk with a suitable policy of insurance. Where such insurance is arranged by the Contractor, the Subcontractor will either agree to pay the Contractor the appropriate premiums on a basis to be agreed verbally, either in advance or as a deduction from the Contractor’s payment statement, or the costs will be reflected in the price or rate agreed with the Subcontractor.
Payment for the Services
-
11) Formal written tenders will not be required. The parties agree that the rate for the Services and the method of payment will be negotiated and agreed between them from time to time and this shall include verbal agreements of the rate of payment for the Services.

12) The agreed rates shall be calculated and determined by the Contractor by re-measurement of the works properly done at the end of each working week (Where applicable).
-
13) The Contractor will provide a pay statement to the Subcontractor in accordance with the requirements of the self-employed Construction Industry Scheme, on a weekly basis. The Subcontractor is then obliged to raise an invoice for the Services ready for payment.
-
14) Any defective work the Contractor reasonably determines has been caused by the Subcontractor will be corrected by the Subcontractor at his own cost or in his own time.
-
15) Any damage the Contractor reasonably determines has been caused by the Subcontractor will be corrected by the Subcontractor at his own cost, or the costs expended by the Contractor to rectify the damage will be deducted from the Subcontractor’s next payment where available funds allow.
-
16) The Subcontractor is responsible for all his travelling expenses to and from any location where he has been engaged to provide the Services. Where transport facilities are made available by the Contractor to a particular location this is entirely at the Contractor’s discretion and such facilities agreed with the Subcontractor.

17) The Contractor and the Subcontractor are subject to the Construction Industry Scheme. The Subcontractor will provide to the Contractor at the earliest opportunity sufficient information to enable the Contractor to verify the Subcontractor’s payment status with HM Revenue & Customs. The responsibility for the accuracy of this information rests with the Subcontractor and the Subcontractor will not be entitled to receive any payment under this contract until this information has been provided to the Contractor.

18) The Subcontractor is responsible for his own National Insurance contributions.
-
19) As an independent business, the Subcontractor agrees that it is not entitled to holiday, sick pay or any other payment for periods when the Services are not provided to the Contractor in any circumstances.
-
20) Payment is dependent on the Contractor receiving payment for services from its client and the Subcontractor accepts that where payment is not received, the Contractor cannot guarantee that the Subcontractor will be paid for those services.
-
21) The Subcontractor is not entitled to participate in the Contractor’s grievance and disciplinary procedures.
-
22) The Subcontractor will not be entitled to receive payment for Services cancelled or where a site is closed, for example by reason of inclement of weather.
Health and Safety
-
23) In the interest of health and safety obligations imposed on the Contractor, the Subcontractor agrees to comply with all reasonable operational rules relating to working hours, site security and safety.

24) The parties acknowledge that it may be necessary for health and safety reasons for the Subcontractor to be identifiable whether evidenced by security passes or on parts of clothing. However, the Subcontractor will not represent himself as a servant or employee of the Contractor at any time, but as an independent subcontractor in business on his own account engaged by the Contractor for the specific purpose of providing the services
Substitutes and Hired Assistants

25) The Subcontractor may, at his absolute discretion, send a substitute or hired assistant to perform the Services. The substitute or hired assistant may be rejected by the Contractor only if in the reasonable opinion of the Contractor such substitute or hired assistant does not possess the necessary skills and qualifications to carry out the Services. All substitutes or hired assistants must have a minimum qualification as follows:-
-
a. A valid CITB – Construction Skills Health, Safety and Environmental qualification.
-
b. A valid CISRS – COTS qualification (Construction Industry Scaffolders Record Scheme – Operative 26) Where a substitute or hired assistant is sent by the Subcontractor there shall be no contractual or financial relationship between the Contractor and the substitute or hired assistant. The Subcontractor is solely responsible for arranging payments to the substitute or hired assistant

Termination of this Agreement
-
27) This agreement can be terminated by either party for any reason and without notice being given.
Miscellaneous
-
28) The Subcontractor confirms that he has read and understood the terms and conditions herein and has had the opportunity to discuss the agreement with any person or professional advisor he considers necessary before signing.

29) Both parties agree this is intended to be a legally binding contract governing the nature of the contractual relationship between them.
-
30) Both parties agree that, with the exception of verbal agreements referred to in clauses 10 and 11, these terms and conditions represent the whole agreement between them. No variations may be made to these terms unless agreed in writing by both parties.

31) Should the Contractor fail to enforce or apply any of the rights that is has under this Contract for Services, it shall not be construed that the Contractor approves or agrees to any breach of contract in the future.

32) The Subcontractor shall not use the name, any adaptation of the name, any logo, trademark or other device of the Contractor, or any part of it, in any advertising, promotional or sales materials without the prior written consent of the Contractor.

33) The Headings used in the Contract for Services are for ease of reference only and are not intended to be interpreted as part of the terms agreed between the parties. References to the masculine include the feminine
