SITE INSTRUCTION DETAILS.

  • NOTE WHERE THE INSTRUCTION INVOLVES A CHANGE OF MATRIAL OR CONSTRUCTION METHOD A VARIATION DOCUMENT NEEDS TO BE ISSUED AND SIGNED BY THE OWNER AND CONTRACTOR.

  • Is the instruction being given by the owner to carryout works which the contractor has advised the owner will be contrary to relevant criteria under section 20 of the Act, and not fit for purpose.

  • In the course of carrying out the contracted works under the Act, the Owner/s has requested and insisted that the Contractor leave certain works which the Contractor has advised the Owner will be contrary to the relevant criteria under section 20 of the Act, and not fit for purpose.

  • This notice therefore sets out:

  • (1) that the contractor gives the Written Advice to the Owner in writing under section 20 (4)(b) of the act.

  • (2) that the Owner rejects the written Advice and instructs the Contractor comply with the Owners Instructions, and

  • (3) that the Contractor agrees to comply with the Owners Instructions by a written variation signed by the Owner under section 40 of the act.

  • The act means the Queensland Building and Construction Commission Act 1991

  • Where the verbal instruction would give rise to a negative or positive change in the contract sum, all parties agree where a positive increase occurs the works will not be actioned until a variation is submitted and sign by the home owner. Where a negative variation is required this will be supplied as soon as practical but prior to the next staged payment.
