1. Child resistant door sets

1.1. Door sets are not permitted in any part of the pool safety barrier. Building Code of Australia (BCA 2010 – Cl 3.9.3.0 (b) as applicable)

1.2. Is the pool area totally self-contained within the envelope of its own pool safety barrier?
2. Child resistant windows

Where the height from the sill to the lowest opening panel of a window to the floor is not greater than 900 mm, then either of the following shall apply-

2.1. Is the openable part of the window/s restricted from opening more than 100mm? or

2.2. Is there a security screen or bars installed to the openable part of window? and
-
2.2.1. If so, are the bars and or security screen fixed with fasteners that can only be removed with a tool?

2.3. If openable part of window is greater than 900 mm and less than 1200 mm measured from the sill to the floor level, then is the openable part of the window fitted with a securely installed flyscreen fixed with fasteners that can only be removed with a tool?
3. Pool Barrier Fence

3.1. Does pool fence have a minimum height of 1200mm measured from approach side?

3.2. Are vertical member spacings a maximum of 100mm apart?

3.3. Are horizontal rails in pool fence spaced a minimum of 900mm apart with bottom rail located 1000mm below top of pool safety barrier?

3.5. Is ground beneath pool fence stabilised or paved to prevent young children from gaining access beneath the pool fence? (Ground firm and well compacted, no loose sand or pebbles etc)

3.6. At stepped or staggered panels has a NCZ of 900mm been maintained? (NCZ 900mm & 1100mm above highest lower climbable member to top & 1200mm high)

3.7. Has an outside NCZ of 900mm been maintained around the entire outside perimeter of the pool fence? (No climbable objects e.g. trees, pot plants, etc within a quadrant of 900mm measured from top of pool fence)

3.8. Has an inside NCZ of 300mm been maintained around the entire inside perimeter of the pool fence? (Not required where gaps in pool barrier are 10mm or less)

3.9. Are pool fence panels secure and firmly fixed in position, including posts?

3.10. Is the pool fence free of any finger or footholds greater than 10mm in depth on the surface or within a 1200mm radius (Arc) and are such footholds a minimum of 900mm apart?

3.12. Has wire mesh been used as part of the pool fence and if so are apertures 13mm or less in width? or

3.13. If wire mesh has been used with apertures greater than 13mm but not more than 100mm, is pool barrier a minimum height of 1800mm?
4. Pool Barrier Gates

4.1. Do pool gate/s swing outwards away from pool unrestricted in its arc of swing?

4.2. Is the pool gate self-closing and self-latching from any position without the use of force including at the latch or from the full open position?

4.3. Is the latch release height a minimum of 1500mm above ground level? or

4.4. Is the latch release mechanism located on the inside of the pool gate?

4.4.1. If so, is it located a minimum of 150mm from top of pool gate?

4.4.2. If so, is the gap at the closing side of the gate 10mm or less?

4.4.3. If so, is latch shielded for a clear radius of 450mm?

4.5. Are gate hinges located a minimum of 900mm apart?

4.6. Is pool gate height a minimum height of 1200mm measured above adjoining ground level?

4.7. Is the gap beneath the pool gate 100mm or less?

4.8. Is the latching device not able to be adjusted without the use of tools, nor locked in an open position?

4.9. Are the pool gates permanently hung and not able to be lifted off the hinges?

5. Boundary Fences

Note. Climbable surface permitted on approach side (Neighbours’ side) of boundary fence where fence measures 1800mm in height and where NCZ exists on the pool side at internal fence and at pool fence junctions.

5.1. Do boundary fences measure a minimum of 1800mm in height?

5.2. Has a 900mm non climb zone been provided on the pool side at internal boundary fence locations? NCZ 5

5.3. Has a 900mm non climb zone been provided at the pool barrier fence and boundary fence location extending 900mm past both sides of pool barrier fence?

5.4. If fence rails exist on pool side of boundary fence does the NCZ extend 900mm past the pool barrier fence junction and extending 300mm inside the pool barrier fence?
6. Retaining Walls
-
6.1. Does the retaining wall have an effective height of at least 1800mm? and if so

6.1.1. Has a 900mm non climb zone been maintained at top section of retaining wall for its entire length when forming part of pool barrier?

6.2. Does the retaining wall slope away from the pool by not more than 15deg to the vertical?
7. ABOVE GROUND POOLS.

7.1. Is the above ground pool a minimum height of 1200mm measured from the adjoining ground or pavement level?

7.2. Has a barrier been placed around pool ladder at the access point?
-
7.3. Has a NCZ of 900mm been maintained around the perimeter of pool? (Including pool filtration equipment and other movable objects)

7.4. Is there a designated access point for the access ladder and if so, is there a separate pool barrier enclosure for the access ladder?
8. BALCONIES
-
8.1. Has a NCZ of 900mm been maintained between any overhanging balcony and which is less than 1800mm from ground level to the underside of the balcony? NCZ 3
9. STRENGTH AND RIGIDITY OF FENCING COMPONENTS
-
9.1. Is the strength and rigidity of the barrier sufficient to resist the forces applied that could reasonably be expected during normal usage? (Note: This can be assessed by an average sized adult pushing against the barrier at the critical points i.e. at the highest point of barrier and halfway between posts)
10. Part 9A -Division 6 – Building Regulations 2018 - Regulation 147ZF (If in the opinion of the Inspector any of the following exist, the Inspector must immediately issue a certificate of pool and spa barrier noncompliance Form 24 to the owner of the land. An answer of YES signifies a Critical Non-Compliance)

10.1. Is the barrier incapable of being made compliant with the applicable standard within 60 days?

10.2. Is the owner unlikely to bring the barrier into compliance with the applicable standard within 60 days?

10.3. Does the non-compliance with the applicable standard pose a significant and immediate risk to life or safety?

10.4. Is there any door and or gate which forms part of the barrier, when in the closed position, can it be opened by a person who is unable to reach the opening mechanism for that door or gate?

10.5. Is there any door or gate which forms part of the barrier unable to be completely closed?

10.6. Is there any part of the barrier less than 1000mm in height measured above the ground?
11. COMPLIANCE:

11.1. Is Pool Safety Barrier compliant with the applicable standard to allow for a Form 23 -Certificate of Compliance to be issued?
-
11.1.1. If non-compliant, will you instead issue the owner a list setting out the non-compliant items, giving the owner up to 60 days in which to bring the Pool Safety Barrier into compliance with the applicable standard? OR
-
11.1.1.1. Inspector must advise owner of his/her intention to carry out a reinspection specifying a date / time not more than 60 days from date of this inspection.

11.1.2. If critical non-compliant, will you instead issue a Form 24 Certificate of Non-Compliance? (Copy must be sent to Local Council)
