Waiver of Liability

The attached Article 90.1 (A and B) of the NFPA 70 National Electric Code, In addition to our reputation for performing electrical projects "right and complete", guides all of the installations we perform for our customers. Our Service, Maintenance and Specialties Divisions endeavor to perform each job with our customer's ultimate safety and satisfaction in mind. Occasionally, it becomes necessary to implement a temporary repair or fix (i.e. emergency service), that due to limited alternative options and the customer's specific needs, requires Hilscher-Clarke to operate outside of the framework of guidance provided by the National Electrical Code (henceforth referred to as NEC). When this occurs, oftentimes the proposed solution presents a higher degree of risk to factors such as life safety, production sequencing, emergency preparedness, equipment protection, etc., than if the work were executed without variance from the NEC. In an effort to mitigate our liability for any work requested that requires us to depart from the NEC Standard, we ask that you the customer review this risk assessment and acknowledge your understanding of the potential consequences that may result from implementing the variance described below.

This list is not intended to be all-encompassing but is representative of the types and nature of deficiences that can be expected by implementing the variance(s) described. It is plausable that other defects not listed above could be encountered as a result of the actions taken. The customer further acknowledges that the work in question is considered temporary and that it is ultimately their responsibility to ensure that the final installation meets all applicable life-safety codes and standards.
