Loaner Agreement

  • Maintenance and Warranties: During the initial rental period and all renewal periods, the Company will provide service for the machines covering normal repairs at NO ADDITIONAL CHARGE. Lessee understands that Lessee will be responsible for the cost of any unauthorized repairs done by others, and for any loss of warranty damage to the machines caused by such unauthorized repair.
    Lessee understands the Company will make every effort to put the machines into good working order within 48 hours (not including days when the Company is closed) or to provide comparable machine for Lessee to use while the original machine is being repaired. In the event neither can be accomplished, Lessee’s renewal date will be deferred by the number of days which pass until the Lessee receives use of the original or substitute machines.

    Lessee understands that the Company warrants only that each rental machine will be in good operating condition. THE COMPANY DOES NOT WARRANT THE MERCHANTABILITY OF THE RENTAL MACHINES NOR ITS FITNESS OR SUITABILITY FOR ANY PARTICULAR PURPOSE OR USE. Lessee understands that the company shall not be liable for any special, incidental or consequential damages, whether in contract, tort or otherwise.

    DAMAGES TO MACHINES: Lessee is responsible for the safekeeping of all machines and shall bear the risk of any loss, theft, damage or destruction of the machines. If requested by the Company, Lessee shall provide evidence of insurance of each machine against such risk of loss for not less that the replacement cost of each machine. If the machine is damaged, Lessee will pay the Company immediately for all repairs, normal wear and tear excepted. In the event of loss, theft or destruction of the machine rental under this rental this lease will continue until the machine has been repaired replaced or the replacement cost has been paid to the Company.

    DAMAGE TO PERSON OR PROPERTY: Lessee understands the Company will not be responsible for any loss or damage to any person or property arising out of the use of the machines.

    FEES AND TAXES: Lessee shall be liable for all taxes assessed on the AGREEMENT, or the machines or their use or value for tax purposes including, but not limited to state and local privilege or excise taxes.

    RETURN OF PROPERTY UPON TERMINATION: If this Agreement is terminated, Lessee agrees to make arrangements immediately with the Company for the Company to regain peaceable the physical possessions of the machines. Lessee agrees to pay rent and any other charges due when the machines are returned. Lessee understands that if Lessee does not allow the peaceable recovery of the machines by the Company and the Company must initiate legal action to recover the machine, in addition to other charges Lessee may owe, Lessee will be liable for all reasonable costs the company incurs, including attorney’s fees and court costs.

    OWNERSHIP OF THE MACHINE: The machines remain the Company’s property and may be removed by the Company at anytime after termination of this agreement or extension thereof.

    ASSIGNMENT: Lessee does not have any right to sell, assign, transfer, sublease, or encumber the machines or in any other way dispose of the machines, during the term of this Rental Agreement or any renewal of the Agreement. The Company may assign the Agreement.

    LESSORS RIGHT TO TERMINATE: The Company may terminate this Agreement if Lessee fails to keep any of its terms of conditions.

    GENERAL: I understand that this agreement shall be governed by the Laws of the state of Texas. The company shall not be responsible for failure to fulfill its obligations under this agreement due to causes of circumstances beyond its control.

    RENTAL/LOANER EQUIPMENT NOT RETURNED ON TIME IS SUBJECT TO ADDITIONAL CHARGES.
