EASA Part 145 Audit Questions

EASA 145.A.95 Findings

145.A.95(a) A level 1 finding is any finding of significant non-compliance with the requirements of this Annex which lowers the safety standard and seriously endangers flight safety.

  • 145.A.95(a) Following receipt of a level 1 finding, Has the organisation complied with the requirements of the applicable Part-145 regulation in that: [145.B.50(a)] the approval of the organisation is revoked, limited or suspended in whole or part - until successful corrective action has been taken?

  • 145.B.50 (a) When during audits or by other means evidence is found showing non-compliance with the requirements of this Annex (Part-145), the competent authority shall take the following actions:
    1. For level 1 findings, immediate action shall be taken by the competent authority to revoke, limit or suspend in whole or in part, depending upon the extent of the level 1 finding, the maintenance organisation approval, until successful corrective action has been taken by the organisation. AMC145.B.50(a) In practical terms a level 1 finding is where a competent authority finds a significant non-compliance with Part-145.
    The following are example level 1 findings:
    — Failure to gain access to the organisation during normal operating hours of the organisation in accordance with 145.A.90(2) after two written requests.
    — If the calibration control of equipment as specified in 145.A.40(b) had previously broken down on a particular type product line such that most ‘calibrated’ equipment was suspect from that time then that would be a level 1 finding.
    A complete product line is defined as all the aircraft, engine or component of a particular type.
    For a level 1 finding it may be necessary for the competent authority to ensure that further maintenance and re-certification of all affected products is accomplished, dependent upon the nature of the finding.

145.A.95 (c) After receipt of notification of findings according to point 145.B.50, the holder of the maintenance organisation approval shall define a corrective action plan and demonstrate corrective action to the satisfaction of the competent authority within a period agreed with this authority.

145.A.95 (b) A level 2 finding is any finding of non-compliance with the requirements of this Annex which may lower the safety standard and may endanger flight safety.’;

  • (b) Following receipt of a level 2 finding, has the organisation accomplished the required corrective action and associated responses recording the corrective action taken, within the corrective action period granted by the competent authority? (Initially, a maximum period of 3 months - The corrective action period granted by the competent authority may be extended in certain circumstances).

  • 145.A.50(a) When during audits or by other means evidence is found showing non-compliance with the requirements of this Annex (Part-145), the competent authority shall take the following actions: 2. For level 2 findings, the corrective action period granted by the competent authority must be appropriate to the nature of the finding but in any case initially must not be more than three months. In certain circumstances and subject to the nature of the finding the competent authority may extend the three month period subject to a satisfactory corrective action plan agreed by the competent authority. (b) (b) Action shall be taken by the competent authority to suspend in whole or part the approval in case of failure to comply within the timescale granted by the competent authority.
