1.0 Training Program (Safety / Training Department)

  • Are employees trained as new hires on their right to access medical records? Training must contain the following: The existence, location, and availability of any records covered by this section;<br><br>1910.1020(g)(1)(ii)<br>The person responsible for maintaining and providing access to records; and<br><br>1910.1020(g)(1)(iii)<br>Each employee's rights of access to these records.

  • Are employees trained annually on access to medical records? 2.0 Access to Medical Records Program (Safety / Medical)

  • Are all records which measures or monitors the amount of a toxic substance or harmful physicals agent to which the employee is or has been exposed to maintained? 1910.1020(e)(2)(I)(A)(1)

  • Does the medical staff ensure a timely response to employees who request medical records?

  • Are MSDS or exposure records maintained for a period of 30 years?

4.0 Employee Knowledge (Employee Questions)

  • Does the medical staff understand their obligations under the access to medical records regulation?

  • Do employees understand their rights under the access to medical regulation?

5.0 Documentation and Retention (Safety / Medical)

  • Are employee medical records maintained for period of employment plus 30 Years? 1910.1020(d)(1)(I)

  • Are employee exposure records maintained for period of employment plus 30 years?

  • Are training records maintained for period of employment?
