Fence/Barrier

  • Is the outside to the pool fence at least 1200 mm high all the way around measured from the outside of the pool?

  • If a boundary fence forms part of the pool barrier, is it at minimum of 1800 mm high, and does it have a 900 mm non-climbable zone located on the inside top of the fencing?

  • Is the gap between the bottom of the fence and the surface beneath less than 100 mm? Is the surface beneath stable?

  • Are all vertical or near vertical rails on the fence less then 100 mm apart? Inspect areas where the internal fence abuts the boundary fence.

  • There are no potential handholds and footholds located within 1100 mm of the top of the pool fence that are located less than 900 mm apart in any direction.

  • If using perforated or mesh fencing, are the holes 13mm or less?

  • Located on the inside of the pool fence, is there a minimum clearance of 300 mm between any objects that could facilitate a foot hold for climbing the pool fence?

  • Is the pool fence well maintained and in a good state of repair as an effective and safe barrier? (eg, no holes, broken rails)

  • If a wall forms part of the barrier, there are no openings greater than 100 mm. Window screens are to be solid and comply with the strength and rigidity requirements and be fixed.

  • Can all windows be opened to a maximum of 100mm, or are permanently fixed with bars or a metal screen?

  • Outside of the barrier, there are NOT any steps, retaining walls, objects or level changes within 500mm that can potentially reduce the overall height of the barrier (less than 1.2m). [clause 2.3.1]

Gate

  • Does the gate swing freely, close and latch by itself from any open position?

  • Is the gate latch working well so that the gate is secure and, once closed, can’t be pulled open?

  • Does the gate open outwards, away from the pool?

  • Is the gate latch 1500mm above ground level or, if located inside the gate, 1200mm above ground level and at least 150mm below the top of the gate (if there is no hand hole) and covered by an approved shield?

  • Is the gap between the bottom of the gate and the surface beneath less than 100 mm? Is the surface beneath stable?

  • Are all vertical or near vertical rails on the gate less then 100 mm apart?

  • The gate latch cannot be locked in the open position.

  • Shielding of the latch - In a gate with openings greater than 10 mm, where the latch release is located at a height of less than 1500 mm above the finished ground level, is the latch release shielded so that no opening greater than 10 mm occurs within the area bounded by - <br>(a) an effective radius of 450 mm from the latch release<br>(b) the top of the barrier, if this intersects the area described in item (a)<br>

  • Are the gate hinges a minimum of 900 mm apart or do they have a surface depth less than 10 mm where located within the NCZ.

Around the pool

  • Is there an appropriate warning sign, including details of resuscitation (CPR) techniques, in the immediate vicinity of the pool area and which can be easily read from a distance of 3 metres?

  • There are no objects or structures, such as BBQs, trees, rocks, shrubs, pot plants, tap fittings, ledges etc. located within the exterior 900 mm NCZ of the pool fence that could facilitate access into the pool area?

  • Are the pool skimmer box, filter, outlet and cover designed in such a way as to prevent a child becoming trapped?

  • Submit certification that the glass fence has been installed in accordance with AS 1288-2006 Glass in Buildings - Selection and Installation Submit certification that the water reticulation system has been installed in accordance with AS 1926.3 - 2010 - Water re-circulation systems
    Swimming pool water re-circulation system requirements seek to minimise the risk of entrapment or injury of people using the swimming pool and provide for the safe operation of skimmer boxes and outlet systems.

ADVISORY NOTE

  • The owner is advised that they are required to safeguard the swimming pool in accordance with the requirements of the Swimming Pool Act 1992 and associated Regulations.

  • The swimming pool barrier shall be constructed in accordance with the requirements of the Building Code of Australia and referenced Australian Standard 1926.

  • Where a non-compliance is identified that requires the pool fence to be modified; the swimming pool barrier is required to be upgraded to comply with the current requirements of the Building Code of Australia and referenced Australian Standard 1926.

  • Swimming Pools Regulation 2018 Clause 21
    (8) A certificate of non-compliance is not valid at any time during which the premises on which the swimming pool is located are subject to a residential tenancy agreement under the Residential Tenancies Act 2010.

    If the property is leased then the owner/real estate agent are in breach of their legislated obligations

  • A period of six weeks from the date of a requested compliance inspection is given to complete the required works - once this period has lapsed council will follow up by issuing a Direction to have the works completed within a specific time frame. Failure in completing the works within the specified time frame may result on council issuing fines or taking further legal action.

  • Any defects noted in the report above are potentially life threatening and require your immediate attention.
