Assessment

  • Does the building appear to comply with objectives of the BCA? If not, what works would be necessary?

  • Are there are no likely adverse effects on the environment?

  • Are there are no likely adverse effects on adjoining properties or other properties in the locality?

  • It is unlikely that issuing the BIC will set a precedent that would encourage other such works without obtaining approval?

  • Are there are no outstanding compliance actions or orders or complaints made by the public that have not been resolved or addressed?

  • Is the building or part is consistent with an issued development consent?

  • Is the building or part is such that it is likely an application for its construction would have been approved had it been applied for?

  • Is the building or part is suitable for occupation in accordance with its classification and will it not be a hazard to the health & safety of the occupants?

  • It is unlikely that Council will need to issue an order for the building or part to be altered or demolished?

  • Before Council is able to issue the Building Information Certificate, the following minor works are to be carried out:

  • To enable a proper determination of the application, Council is requesting the following information to be provided as per Clause 6.26(2) of the Environmental Planning and Assessment Regulation 2021. Please provide:

  • Council has determined to refuse the Building Information Certificate Application under Clause 6.26(4) for the following reasons. • deficiencies in the submitted material • non-compliances with the BCA • inconsistencies with the approved building design • inconsistencies with the approved use • health, safety or environmental issues • Council is likely to issue and Order in relation to the building However, if the following work is carried out, it is likely that a Building Information Certificate may be issued subject to a subsequent Building Information Certificate application being lodged.
