2.1 General

  • Barrier & gate must be a permanent structure, made from durable material.

2.3.1 fencing height

  • Barrier height not less than 1.2m.

  • NCZ 1.2m radius down from the top of the barrier (outside).

  • Reg147C(C) - If paling fence must be minimum 1.5m high.

2.3.2 Perforated material or mesh

  • Openings in fence not greater than 13mm shall have fence height min 1.2m.

  • (a) Openings in fence greater than 13mm but less than 100mm shall have fence height min 2.4m. OR

  • (b) Openings in fence greater than 13mm but less than 100mm with a cranked top shall have a height not less than 1.8m.

2.4 Retaining wall or other such barrier (on high side of pool)

  • (a) Minimum 2.4m high (& in accordance with Clause 2.6)

  • (b) Does NOT slope more than 15⁰

2.4 Retaining wall or other such barrier (on low side of pool)

  • (c) Minimum 1.2m high (& in accordance with Clause 2.6) OR

  • (d) Minimum 2.4m high (if not compliant with Clause 2.6)

2.5 Ground clearance

  • Gap between ground and barrier no greater than 100mm.

2.6 Outside surface

  • If projections or indentation greater than 10mm they must be no less than 900mm spaced apart.

  • Any lower indentations or projections to be minimum 1.1m from top of barrier

  • Ignore projections/indentations if horizontal members have minimum 60⁰ splay

  • If fence specifically designed to lean towards pool - must NOT slope more than 15⁰

2.7 Horizontal climbable members [includes boundary fence. Outside of pool area]

  • (a) Horizontal members shall be no less than 900mm apart if vertical openings are greater than 10mm.

  • (b) Fences with rails - top surface of lower rail shall be no less than 1.1m below the top of the fence.

2.8 Horizontal non-climbable members

  • (a) horizontal members not complying with 2.7 have 60⁰ splay &

  • (b) Vertical members spaced no more than 10mm apart.

2.9 Horizontal surfaces inside the fencing

  • 300mm deep NCZ maintained within the pool area, unless vertical openings no more than 10mm wide.

2.10 Vertical members

  • Openings no greater than 100mm.

2.11.1 & 147C (b)

  • Gate swings away from pool area.

  • 147D - requirements for doors or gates (A.K.A. child resistant doorsets)
  • (a) self-latching device installed

  • (b) opening mechanism minimum 1.5m high

  • (c) Self-closing device fitted - self-closing device will close the gate from any open position without manual force.

147E windows in walls used as barriers

  • (a) not less than 2.4m above ground level of pool area; or

  • (b) not less than 1.5m above the floor level of the room containing the window; or

  • (c) not openable more than 125mm; or

  • (d) have securely fitted fly screen/mesh of adequate strength.

  • 2.11.3.1 Latching device
  • Automatically operate on the closing of the gate.

  • Cannot be re-opened without manual release.

  • The latch shall not be able to:<br>• inadvertently be adjusted during operation;<br>• locked in the ‘open’ position; or<br>• adjusted without the use of tools.

  • 2.11.3.2 Location of latch (if lower than 1.5m)
  • (a) On the inside of the barrier;

  • (b) Access to the latch must be in a position to reach over or through the barrier no lower than 1.2m above FFL OR,<br>Not less than 1.1m above the highest lower rail.

  • (c) At least 150mm below the top of barrier or hand-hole.

2.11.3.3 Shielding of latch (when latch is below 1.5m)

  • No opening greater than 10mm within 450mm of latch

  • Security of closure - when gate is closed and latched it can’t be:
  • lifted to release the latch OR,

  • unhinge the gate OR,

  • increase the gap underneath greater than 100mm.

2.15 Above-ground pools

  • Pool sides acting as the barrier if height is not less than 1.2m.

  • Must comply with 2.3, 2.6, 2.7 & 2.8.

2.16 Balcony balustrades where balcony floor level is less than 2.4m above NGL of pool area

  • The balcony balustrade must comply as a pool/spa barrier. OR

  • The window/s & door/s must comply with Clause 2.13 & 2.14. (child resistant window & child resistant doorset).

Reg 147ZF - circumstances in which a certificate of barrier NON-compliance must be issued immediately

  • Is the barrier incapable of being made compliant within 60 days?

  • Is the owner unlikely to bring the barrier into compliance within 60 days?

  • Does the non-compliance pose a significant risk to life or safety?

  • Can to gate/doorset be open without operating the latch?

  • Is the gate/doorset unable to be closed completely?

  • Is any part of the barrier less than 1m in height?

  • If the answer is yes to any of these questions, then a Form 24 must be issued immediately.

Compliance

  • Is Pool Safety Barrier compliant with the applicable standard to allow for a Form 23 - Certificate of Compliance to be issued. OR

  • If non-compliant, will you instead issue the owner a list setting out the non-compliant items, giving the owner maximum 60 days in which to bring the Pool Safety Barrier into compliance with the applicable standard.

  • Note. Inspector must advise owner of their intention to carry out a reinspection specifying a date not more than 60 days after the owner receives the notice.
