Fence Structure

Constructed Swimming Pool Barriers

  • Is there a permanent barrier separating the pool from the house and public areas, that will restrict the access of young children into the pool area?

  • At all points along the non-boundary barriers (including gate) , is the distance between the top of the fence and the finished ground level at least 1200 mm, when measured from the outside of the barrier?

  • If a boundary fence forms part of the pool barrier, is it at least 1800 mm high, when measured from inside the pool area?

  • Was the pool constructed prior to 2008, with no previous non-compliances against the Act?

  • * Before 1/9/2008 - Exempt from requirement IF the distance between the top of the fence and the finished ground level are at least 1200 mm, when measured from the outside of the barrier

  • Compliance with AS 1926.1-2012 met?

  • Where an internal barrier, more than 50 mm wide, intersects a boundary barrier, does the first 900 mm of the internal barrier extend to a height of 1800 mm or more?

  • Was the pool constructed prior to 2013, with no previous non-compliances against the Act?

  • * Before 1/5/2013 - Exempt from requirement

  • Compliance with AS 1926.1-2012 met?

  • Was the pool constructed prior to 2008, with no previous non-compliances against the Act?

  • * Before 1/9/2008 - Exempt from Requirement IF the apertures are less than 50 mm wide AND the barrier is at least 1800 mm high topped with a 450 mm section angled 135 deg away from the pool, when the apertures exceed 12mm

Building Barriers

Building as a barrier

  • Does a building form part of the swimming pool barrier?

  • When was the swimming pool constructed?

  • * After 1990 - Yes, and there are no openings from this portion of the building that would permit access to the pool. A childproof barrier separates the pool from all accessible parts of the building in accordance with the Act and standards

  • * Before 1990 - The building is designed to restrict entry from habitable portion of the premises and the pool area. There is a fence that separates the neighbourhood and the pool area.

Indoor door latches

  • Do doors form part of the barrier between internal areas of dwellings and the swimming pool area?

  • What was the year of swimming pool construction?

  • * After 1/9/2008 - are all doors between indoor areas and pool areas fitted with self-latching devices that are located at least 1500 mm above the ground for INDOOR POOLS ONLY?

  • * Before 1/9/2008 - Doors entering INDOOR POOLS ONLY from indoor areas have a child-safe lock, chain, bolt or other device at least 1500 mm above the ground

  • *Before 1/8/1990 - POOLS EXEMPT FROM BARRIER REQUIREMENTS ONLY are all doors between indoor areas and outdoor pool areas fitted with self-latching devices that are located at least 1500 mm above the ground?

Indoor No Climb Zones

  • Depending on the year of construction and the nature of the pool (see below) is the area inside the building, within 900 mm of the door that opens to a pool area, free from climbable structures, to a height of 1200 mm?

  • * After 1/5/2013 - Complies with requirement for INDOOR POOLS ONLY.

  • * Before 1/5/2013 but after 1/8/1990 - INDOOR POOLS ONLY exempt from requirement IF the bottom 1000 mm of door structure is free of foot holds greater than 10 mm wide

  • *Before 1/8/1990 - Complies with requirement for POOLS EXEMPT FROM BARRIER REQUIREMENTS ONLY

Balconies

  • If present, do balconies that protrude into no-climb zones have balustrades that comply with the requirements for internal barriers (see below)?

  • *After 1/5/2013 - Complies with above requirement

  • *Before 1/5/2013 - Must comply with requirement; however, all balconies more than 1800 mm above finished ground are exempt from above requirement

  • *Before 1/9/2008 - Exempt from above requirement

Gates

Gate closure and movement

  • Is the gate kept securely closed?

  • Does the gate swing away from the pool area?

  • Whilst latched, is the gate unable to be pulled open under force?

  • Does the gate swing freely, self- latch and close from a stationary start at any open position?

Latching device

  • Is the latching device in good working condition and unable to be locked in the 'open' position, or adjusted without tools or intent, unless exempt (see below)?

  • Was the swimming pool constructed prior to 2008?

  • * Before 1/9/2008 - Exempt from requirement IF in good working condition

  • * After 1/9/2008 - Swimming pool barrier must comply with AS 1926.1-2012 requirement above

  • Where the latching device is outside the pool fence, is it at least 1500 mm above ground level?

  • Was the swimming pool constructed between 2008 and 2013, with no previous non-compliances?

  • *Before 1/5/2013 but after 1/9/2008 - Must comply with above requirement AND latching device must ALSO be 1400 mm above highest lower horizontal member

  • * Before 1/9/2008 and after 1/5/2013- Swimming pool barrier must comply with above requirement

  • Where the latching device is inside the pool fence, is it at least 1200 mm above ground level, at least 1000 mm above the highest lower horizontal member, unless exempt (see below)?

  • Was the swimming pool constructed prior to 2008?

  • * Before 1/9/2008 - Exempt from requirement if latching device is located inside the gate, 1200mm above ground level, and at least 150mm below the top of the gate or 150mm away from a hand-hole opening?

  • * After 1/9/2008 - Swimming pool barrier must comply with AS 1926.1-2012 requirement above
