  • What is a Swimming Pool?

    swimming pool means an excavation, structure or vessel:

    (a) that is capable of being filled with water to a depth greater than 300 millimetres, and

    (b) that is solely or principally used, or that is designed, manufactured or adapted to be solely or principally used, for the purpose of swimming, wading, paddling or any other human aquatic activity,

    and includes a spa pool, but does not include a spa bath. Anything that is situated within a bathroom or anything declared by the regulations not to be a swimming pool for the purpose of the Act.

    2.59 Specified development

    The construction or installation of a portable swimming pool or spa or a child-resistant barrier that is required under the Swimming Pools Act 1992 is development specified for this code if it is not constructed or installed on or in a heritage item or a draft heritage item or on land in a foreshore area.

    Development standards
    2.60 Development standards

    (1) The standards specified for that development, if it is the construction or installation of a portable swimming pool or spa, are that the development must:
    (a1) be for residential uses only, and
    (a) be located in the rear yard, and
    (b) be located at least 1m from each lot boundary, and
    (c) not exceed 2,000 L in capacity, and
    (d) not require structural work for installation, and
    (e) not impact on the structural stability of any building.
    (2) A child-resistant barrier must be constructed or installed in accordance with the requirements of the Swimming Pools Act 1992 .

Fence/Barrier

  • Existing complying swimming pools may continue to comply with earlier standards. Has the barrier been substantially altered or rebuilt? Does the barrier require an upgraded to comply with AS1926.1 2012 as described in the Regulations?

  • Is there a pool fence or other child-resistant barrier separating the pool from your house and adjoining properties and public spaces at all times?

  • Is the outside to the pool fence at least 1200mm high all the way around?

  • The height shall be considered effective if a quadrant of radius 1.2m, located as shown in figure 2.1. Does the fence/barrier comply with this requirement?

  • The height along the length of the fence shall be measured perpendicular to the finished ground level (see figure 2.2) Does the fence/barrier comply with this requirement?

  • The top surface of the highest lower horizontal member shall be at least 1.1m below the top of the fence or gate. Where the ground slopes, the top surface of the highest lower member shall be at least 1.1m below the top of the fence, measured perpendicular to the finished ground level (see Figure 2.2 and 2.4)

  • Any nearby horizontal surfaces permanently located near the inside of the fencing shall be separated from the fencing by a distance of at least 300mm. Does the fence/barrier comply with this requirement?

  • Projections from, or indentations into, the outside surface of the fence or gate, or a combination of projections and indentations, shall not form a substantial horizontal surface with a depth greater than 10mm, unless they are spaced at least 900mm apart and provided that the lower of any projections or indentations is at least 1.1m below the top of the fence or gate. (see figure 2.4)

  • Is the fence either be vertical, leaning away from the pool? (see figure 2.1)

  • Is the gap between the bottom of the fence and the ground less than 100mm?

  • Are all vertical or near vertical rails on the fence less than 100mm apart?

  • Is the distance between any potential handholds and footholds on the pool fence and its associated space at least 900mm apart to inhibit a young child from climbing over it?

  • If using perforated or mesh fencing, are the holes 13mm or less?

  • Fences using perforated materials or mesh (see Clause 2.9), such as chain wire, shall consist of a vertical section having an effective height of at least 1.8m, topped with an angled section measuring 450mm which shall be inclined to the outside of the fence at an angle of 135 degrees from the vertical. See Figure 2.3

  • Is the pool fence well maintained and in a good state of repair as an effective and safe barrier? (eg, no holes, broken rails)

  • Are all fencing panels secure?

  • If the wall of the house forms part of the barrier, is the wall without windows, doors or other openings through which a young child could gain access at any time?

Gate

  • Has the gate been hung so that when a gate is closed and latched, and is lifted upwards or pulled downwards with a force of 250 N, movement of the gate does not release the latch, unhinge the gate; or increase the opening between the bottom of the gate and the finished ground level to more than 100 mm?

  • Does the gate swing freely, close and latch by itself from any open position?

  • Does gate shut and latch from a smaller opening, or resting on the latch mechanism?

  • Does the gate latch and stay latched after it shuts?

  • Is the gate latch working well so that the gate is secure and, once closed, cannot be pulled open?

  • Does the gate open outwards, away from the pool?

  • Does the gate swing freely, close and latch by itself from any open position with a stationary start and without the application of manual force?

  • Is the gate latch 1500mm above ground level or, if located inside the gate, 1200mm above ground level and at least 150mm below the top of the gate (if there is no hand hole) and covered by an approved shield?

  • Are gate hinges 900mm apart? Or non-climbable?

  • Is the gap between the bottom of the gate and the ground not more than 100mm?

  • If gate latch is located inside the gate, is the opening between the gate post and the gate style of more than 10mm?

  • Where the release to the latching device is located at a height less than 1.5m, does the shielding of the latch comply with Clause 2.8.6?

  • Is the gate propped open?

Around the pool

  • Is there an appropriate warning sign, including details of resuscitation (CPR) techniques, in the immediate vicinity of the pool area and which can be easily read?

  • Does the pool have any structures apart from the swimming pool and such other structures (such as diving boards and pool filtration plants) as are wholly ancillary to the swimming pool, within the bounds of the swimming pool barrier?

  • Is the barrier a permanent structure free of sharp edges, sharp projections, and similar hazards?

  • Are the any objects or structures, such as BBQs, trees, rocks, shrubs, pot plants, tap fittings and deckchairs, located within 1.2 metres of the exterior of the pool fence that could facilitate access into the pool area?

  • Are the any objects or structures, such as BBQs, trees, rocks, shrubs, pot plants, tap fittings and deckchairs, located within 300 millimetres of the interior of the pool fence that could facilitate access into the pool area?

  • Are the pool skimmer box, filter, outlet and cover designed in such a way as to prevent a child becoming trapped?

  • Are pool chemicals kept out of view and reach of young children?

  • Have you installed a conductive earthing system bonded to all conductive equipment (eg. metal rails, diving board, reinforced concrete) in the pool area to prevent electric shock?

  • Are all vertical or near vertical rails on the fence less then 100mm apart?

  • Is the distance between any potential handholds and footholds on the pool fence and its associated space at least 900mm apart to inhibit a young child from climbing over it?

  • In addition to the provisions of Clause 2.2, steps, retaining walls, objects or level changes that would otherwise reduce the height of a barrier within a property shall not be located within 500mm of the barrier (see Figure 2.1(a)) Does the barrier comply with this requirement?

  • The surface beneath the barrier shall be permanent and not easily removed or eroded by young child, animals or weather. Does the barrier comply with this requirement?

  • If using perforated or mesh fencing, are the holes 13mm or less?

  • Is the pool fence well maintained and in a good state of repair as an effective and safe barrier? (e.g, no holes, broken rails)

  • Are all fencing panels secure?

  • If a window opens into the pool area does it comply with the requirements of Clause 2.6?

  • If a door opens into the indoor pool or part of the pool area does it comply with the requirements of Clause 2.7?

  • Does the location of the balcony comply with the requirements of clause 2.8?

  • Does the above ground pool comply with the requirements of clause 2.9?

Gate

  • Does the gate open outwards, away from the pool?

  • Is the gate located so that the arc of operation is clear of any building or doorway?

  • Does the gate have sufficient clearance to swing freely through the arc of operation?

  • Does the gate swing freely, close and latch by itself from a fully open position with a stationary start, and resting on the latch mechanism?

  • Is the gate latch working well so that the gate is secure and, once closed, can’t be pulled or shacked open? Refer to 2.4.1.3 of the Standard

  • Does the gate latch and stay latched after it shuts?

  • Is the gap between the bottom of the gate and the ground not more than 100mm?

  • Has the gate been hung so that when a gate is closed and latched, and is lifted upwards or pulled downwards with a force of 250 N, movement of the gate does not release the latch, unhinge the gate; or increase the opening between the bottom of the gate and the finished ground level to more than 100 mm.
