Prices do not include VAT unless otherwise stated in agreement and is subject to terms & conditions stated below. Spare parts & repairs are also charged separately, services will run concurrent with the terms & conditions stated on reverse side and any agreed prices & packages offered. All maintenance & services will be in direct correlation with the British Standard Code of Practice

Terms & Conditions

1. The Company undertakes to send a Service Engineer the agreed number of times each year to test and inspect the equipment at the address overleaf provided that ready access can be obtained to your premises and to the equipment within normal working hours. The Company can accept no liability for the inspection of servicing of any equipment not made available at the time of a scheduled visit. Provision of specialist access equipment will be the responsibility of the Customer.
2. The Company undertakes to issue the Customer a Certificate of Inspection after each visit. A report in respect of any equipment found to be no longer serviceable will be made aware of followed by a written quotation detailing the repair/replacement cost.
3. Additional charges will be made for repairs, alterations or additions to the equipment for part and for any extra work undertaken at the time of the service inspection and not comprised in a normal scheduled service visit including time lost in the delay in obtaining access to the equipment or interruption of work and work done outside normal working hours at the Customer’s request, except where there is a warranty in respect of any defective equipment.
4. Unless otherwise stated overleaf, emergency call outs requested by the Customer between routine service intervals will be charged at the prevailing hourly rate plus mileage together with all materials used being charged at the current list price. The prevailing hourly rate is determined in three separate bands: Normal daytime, out of working hour’s weekday and out of hour’s weekend and public holidays. Hourly rates are different for each category. Normal hours are taken as 08:30 to 16:30 Monday to Friday excluding Bank/Public Holidays.
5. The Customer agrees that whilst this agreement remains in force, the equipment shall only be serviced by the Company’s employees or authorized agents and such work will not be carried out by others.
6. The liability of Cura Property Services is limited to the obligations set out above and to any liability they might have for personal injury or death caused by the sole negligence of their employees of for other loss or damage caused by such negligence in the course of work carried out by them. They do not accept liability for any indirect or consequential loss or damage however caused. Nothing contained in these conditions shall affect the statutory rights of the Customer.
7. Default in payment. If you fail to make payment within the time allowed for payment of an amount due under any contract with us, we shall be entitled:
a) To charge interest on amounts which are overdue more than 30 days of a rate of 5% per month
b) To suspend any work/or delivery of any goods and/or remove any goods delivered or installed which are the subject of all or any such contracts but each suspension shall not in any respect release you from your obligation under such contract and we shall be entitled to add to the price payable for such goods/services the increased costs resulting from the suspension
c) To terminate the contract as if you had wrongfully refused to accept the goods/service to which it relates and claim damages for breach of contract.
8. The Company’s standard Terms and Conditions of Sale shall apply to any goods supplied to a Customer
9. The agreement shall continue for the period length above and then may be terminated by either party by giving a minimum of 3 months written notice. If early termination is made all outstanding charges as per the agreement will still apply.
