2.1 General
-
Barrier height not less than 1.2m on approach side.

Barrier & gate must be a permanent structure, made from durable material.
2.3 NCZ barriers less than 1.8m in height - (outside of boundary fence excluded)

2.3 Boundary barriers

2.3.2 Perforated material or mesh

Openings in fence not greater than 13mm shall have fence height min 1.2m.

Openings in fence greater than 13mm but less than 100mm shall have fence height min 1.8m.

Openings greater than 100mm not permitted.
2.3.3 Surface projections & indentations
-
No foothold allowed greater than 10mm within NCZ, OR
-
If projections or indentation greater than 10mm they must be no less than 900mm spaced apart.
2.3.4 Horizontal climbable members - on outside of barrier or on inside of barrier when vertical openings greater than 10mm (barrier less than 1.8m high)

(a) Horizontal members shall not be in a climbable zone.

(b) Fences with rails - top surface of lower rail shall be no less than 1m below the top of the fence. OR
-
comply with Clause 2.3.5
2.3.5 Horizontal non-climbable members (on outside of fencing)

(a) horizontal members have 60⁰ splay &

2.5 Gates & fittings

2.5.1 - Gate swings away from pool area.

2.5.2 - Arc of gate operation clear of any obstruction.

Opening under closed gate not greater than 100mm.

2.5.3 - Self-closing device fitted.
-
Self-closing device will close the gate from any open position without manual force.
2.5.4 Latching device
-
Automatically operate on the closing of the gate.
-
Cannot be re-opened without manual release.
The latch shall not be able to:
-
(a) inadvertently be adjusted during operation;
-
(b) locked in the ‘open’ position; or
-
(c) adjusted without the use of tools.
2.5.4.2 Location of latch
-
Minimum 1.5m high.
If less than 1.5m high the latch must be:
-
(a) On the inside of the barrier;
-
(b) Access to the latch must be in a position to reach over or through the barrier no lower than 1.2m above FFL OR, Not less than 1m above the highest lower rail.
-
(c) At least 150mm below the top of barrier or hand-hole.
Security of closure - When gate is closed and latched it can’t be:
-
lifted to release the latch OR,
-
unhinge the gate OR,
-
increase the gap underneath greater than 100mm.
2.5.4.3 Shielding of latch when latch is below 1.5m
-
No opening greater than 10mm within 450mm of latch
-
Latch at least 150mm below the top of barrier or hand-hole.
2.6.1 Retaining wall above pool level
-
(a) must be 1.8m high &
-
(b) Not sloped away from pool area more than 15⁰
2.6.2 Retaining wall below pool level
-
Not slope towards the pool by more than 15°
-
(a) Minimum 1.2m high with surface compliant with 2.3.3, OR
-
(b) Not less than 1.8m high (including compliant NCZ)
2.6.3 Permanent bodies of water
-
Permanent bodies of water such as canals, lakes, rivers with a depth of water not less than 300 mm at the edge of the pool area shall be considered as an effective barrier.
2.7 Child resistant windows [sill height less than 1.8m above pool area]
-
(a) When the window is 900mm or less to floor level of room - (i) Protected by bars or mesh screen (not flyscreen) securely fitted to the openable part of window/s OR (ii) Openable part of window/s restricted to max 100mm.
-
(b) Sill height 900mm to 1.2m from room floor level must comply with (a)
-
(c) [if not compliant with (a) or (b)] sill height must be minimum 1.2m above room FFL.
2.8 Child resistant doorsets
-
(a) Fitted with a self-latching device.
-
(b) Self-closing device closes the door from any open position without manual force.
-
(c) Latch release not less than 1.5m high.
-
(d) No footholds permitted wider than 10mm in door or frame from ground to 1m above FFL.
-
(e) & (f) Must comply with Clause 2.3.2, 2.5 & 2.5.4

(h) Pet doors in doorset not allowed

2.9 Balcony balustrades
-
(a) If the balcony is less than 1.8m above ground level of pool area the balcony balustrade must comply as a barrier. OR
-
(b) If the balcony protrudes into a NCZ the balcony balustrade must comply as a barrier.
2.10 Above-ground pools (no barrier)
-
If pool sides are greater than 1.2m high, stable and NCZ’s are clear then the pool itself is considered an adequate barrier.
-
A barrier and gate shall be provided in accordance with AS1926.1 around the access ladder.
Reg 147ZF - circumstances in which a certificate of barrier NON-compliance must be issued immediately

Is the barrier incapable of being made compliant within 60 days?
-
Is the owner unlikely to bring the barrier into compliance within 60 days?
-
Does the non-compliance pose a significant risk to life or safety?
-
Can to gate/doorset be open without operating the latch?
-
Is the gate/doorset unable to be closed completely?
-
Is any part of the barrier less than 1m in height?
-
If the answer is yes to any of these questions, then a Form 24 must be issued immediately.
Compliance
-
Is Pool Safety Barrier compliant with the applicable standard to allow for a Form 23 - Certificate of Compliance to be issued. OR
-
If non-compliant, will you instead issue the owner a list setting out the non-compliant items, giving the owner maximum 60 days in which to bring the Pool Safety Barrier into compliance with the applicable standard.

Note. Inspector must advise owner of their intention to carry out a reinspection specifying a date not more than 60 days after the owner receives the notice.
