Factories ordinance requirements check list

No person shall be the occupier of any factory, unless such factory is registered and licensed in accordance with the provisions of this Ordinance and the regulations

Company Registration

A factory shall be kept in a clean state and free from effluents coming from drains, sanitary convenience or nuisance

Evidance at Site

A factory shall not, while work is carried on, be so overcrowded as to cause risk of injury to the health of the persons employed therein

Space availability not less that 400 cb. Feet per person

A notice to be posted in each workroom specifying the number of persons, who may be employed in that room. (having regard to the provisions of section 7)

Effective provision shall be made for securing and maintaining a reasonable temperature in each workroom, but no method shall be employed which results in the escape into the air of any work room of any fume of such a character and to such extent as to be likely to be injurious or offensive to persons employed therein

Effective and suitable provision shall be made for securing & maintaining by the circulation of fresh air in each work room the adequate ventilation of the room, and for rendering harmless, so far as practicable, all fumes, dust and other impurities injurious to health that may be generated in the course of any process or work carried on in the factory

Effective provision shall be made for securing and maintaining sufficient and suitable lighting, (5' candles at a level of 3" above the floor over the interor parts of the factory)whether natural or artificial, in every part of a factory in which persons are working or passing

Effective means should be provided to drain off any water or other liquid generated from any process in the factory

Sufficient and suitable sanitary conveniences for the persons employed in the factory shall be provided, maintained and kept clean, and effective provision shall be made for lighting the conveniences and, where persons of both sexes are or are intended to be employed such conveniences shall afford proper separate accommodation for person of each sex

Every flywheel directly connected to any prime mover and every moving part of any prime mover, irrespective of their position, and every part of electrical generators, motors and rotary converters and every fly wheel directly connected thereto must be securely fenced except if it is in a safe position

Every part of the transmission machinery shall be securely fenced unless it is in such a position or of such construction as to be as safe to every person employed or working on the premises as it would be if securely fenced

Any person who imports, sells or lets on hire, or as agent of the importer, seller or hirer causes or procures to be imported, sold or let on hire, for use in a factory in Sri Lanka any machine intended to be driven by mechanical or electrical power which does not comply with the requirements of this section, shall be guilty of an offence

Every fixed vessel, structure, sump or pit of which the edge is less than three feet above the adjoining ground or platform shall, if it contains any scalding, corrosive or poisonous liquid, either be securely covered or be securely fenced to at least that height

A woman or young person (age 14 – 18) shall not clean any part of a prime mover or of any transmission machinery while the prime mover or transmission machinery is in motion, and shall not clean any part of any machine if the cleaning thereof would expose the woman or young person to risk of injury from any moving part either of that machine or any adjust machinery

No young person (age 1418) shall work at any machine to which this section applies, unless he has been fully instructed as to the dangers arising in connection with the machine and the precautions to be observed, and

(a) has received a sufficient training in work at the machine or

(b) is under adequate supervision by a person who has a through knowledge and experience of the machine

Every hoist or lift shall be of good mechanical construction, sound material adequate strength, and be properly maintained

Every hoist or lift shall be thoroughly examined by a competent person at least once in every period of twelve months

All parts and working gear whether fixed or movable, including the anchoring and fixing appliances, of every lifting machine shall be of good construction, sound material, adequate strength and free from patent defect, and shall be properly maintained

All such parts and gear as aforesaid shall be thoroughly examined by a competent person at least once in every period of fourteen months

All floors, steps, stairs, passages and gang ways shall be of sound construction and properly maintained

For every staircase in a building or affording a means of exit from a building, a substantial handrail shall be provided and maintained

Ensure adequate precautions are taken against storage of explosive or inflammable dust, gas, vapour or substance during processing, storage, opening up the vessel, welding, brazing, soldering, and cutting

Every air receiver and its fittings shall be of sound construction and properly maintained

Every air receive shall be thoroughly cleaned and examined at lest once in every period of twentyfour months,

Every gas receiver and its fittings shall be of sound construction properly maintained

Every gas receiver and its fittings shall be thoroughly cleaned and examined at least once in every period of twelve months

Every gasholder shall be of sound construction and shall be properly maintained

storgae capacity of the gasholder should be not less 5000 cb.feet

Every gasholder shall be thoroughly examined externally by a person who is the holder of a certificate

Every factory shall provide means of escape in case of fire and it shall be maintained, identified and free of obstruction. Notify to Factory Inspector whenever alteration to factory and its operation is performed

Emergency exit doors shall open outwards except for sliding doors), shall not be fastened, Hoists and lifts shall be securely enclosed with fireresisting materials. Exists shall be marked. Effective means of providing audible warning in case of a fire

Every window, door, or other exit affording means of escape in case of fire or gyring access thereto other than the means of exit in ordinary use, shall be distinctively and conspicuously marked by a notice printed in red letters of an adequate size

Where in any factory more than twenty persons are employed in the same building above the first floor or more than twenty feet above the ground level, or explosive or highly inflammable materials are stored or used in any building where persons are employed, effective steps shall be taken to ensure that all the persons employed are familiar with the means of escape in case of fire and their use and with the routine to be followed in case of fire.(fire emergency drills)

Suitable wholesome drinking water, suitable washing facilities, provision for storage of clothing not worn during work, readily accessible firstaid boxes shall be supplied

Employees shall not expose to dust, fumes or engine exhaust. Ammonia or chlorine or any other asphyxiant or irritant gas or vapour shall not be present in areas ordinarily used by workers (and if so measures taken shall be certified to be effective by chief factory inspector, approved breathing apparatus is provided along with harnesses and works under supervision)

Wherever an activity posses a risk to eyes appropriate protection shall be provided

Signage & Usage of PPEs

No person shall be employed to lift, carry or move any load so heavy as to be likely to cause injury to him

No person employed in any factory shall be exposed to noise above a prescribed upper limit, unless such person is provided with suitable ear defenders

In every factory where electrical energy is generated, transformed, distributed or used and in every premises referred to in section 80,the installations shall conform to the regulations

When an accident occurs in a factory, which causes a loss of life or disability in excess of three days or makes a person unconscious as a result of heat, exhaustion, electric shock or inhalation of irrespirable or poisonous fumes or gases, written notice (Form 10) to be given to District Inspector of Factories with a copy to Chief Inspector of Factories as specified in the section

General register

A young person who works in a factory whether for wages or not in collecting, carrying or delivering goods, carrying messages or running errands shall be deemed to be employed in the factory for the purpose of this ordinance
